Terms of Sale for Customization Services

TIP

In short, Garnet's customization terms are:

  • Bug fixing free and forever,
  • 50% of the payment before we start, 50% on delivery,
  • if it is customer facing, you own the feature and the code, otherwise it is owned by Garnet.

Scope of Services

Garnet offers a wide range of customization services for e-commerce stores, providing tailor-made solutions based on individual client needs. Clients may request any custom solution to enhance their online marketplace.

Pricing and Payment Structure

The cost of customization is determined on a case-by-case basis in consultation with the client. There is no standard fee. Clients are required to pay half of the agreed amount before the commencement of the project, and the remaining half upon delivery. Payments can be made via wire transfer, PayPal, or deducted from Shopify accounts.

Delivery Timeline

The timeline for delivery varies based on the complexity of the customization. Garnet will provide an estimated delivery date prior to the payment of the initial half of the invoice. The client will be kept informed of any changes to this timeline.

Revisions and Modifications

Garnet allows for one round of revisions after the initial delivery. Clients will receive a video demo before the final delivery date to facilitate this revision process. Additional revisions can be requested at a fee to be mutually agreed upon between Garnet and the client.

Cancellation Policy

If a project is cancelled before half of the delivery timeline has passed, the initial deposit will be retained by Garnet as a cancellation fee. If the cancellation occurs after half of the delivery timeline has passed, the full payment will be due.

Ownership and Licensing

If the customized code is deployed and maintained by Garnet, it remains the property of Garnet. If the code is deployed on the client's side, the client has the right to reuse it as they see fit.

Support and Maintenance

Garnet provides bug fixing services free of charge for issues within the project's scope, for the lifetime of the project.

Liability and Warranty

Garnet explicitly disclaims any liability for any loss of business or sales that the client's e-commerce store may incur. Garnet is not responsible for any direct, indirect, incidental, or consequential damages that may arise from the use of its customization services. No warranties, either express or implied, are provided by Garnet in relation to the customization services offered.

Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the issue through amicable negotiations. If a resolution cannot be reached, the dispute will be submitted to binding arbitration in Singapore, in accordance with the rules and procedures of the Singapore International Arbitration Centre.

Governing Law

These terms and any disputes arising from them will be governed by the laws of Singapore.

Confidentiality

Garnet respects the confidentiality of its clients. If requested, a Non-Disclosure Agreement (NDA) can be signed to protect any sensitive information shared during the customization process.

Payment methods

Customizations can be paid through wire transfer, Paypal, Revolut or invoiced directly from your Shopify bill.
